  • The process of providing financial documents to the other party in a divorce case is very important.  If all documents are not provided, it could give the other side a reason to come back to court later and ask to have the division of assets re-addressed.  So, it's very important to make sure that all relevant financial documents are disclosed before settling any financial matters.  Colorado law says that the following documents must be exchanged by the parties: 

    1. Sworn Financial Statement

    2. Income Tax Returns - Personal and business federal income tax returns for the most recent three (3) years

    3. Personal Financial Statements - all personal financial statements and credit/loan applications prepared during the last three (3) years

    4. Business Financial Statements - all business financial statements for the last three (3) fiscal years

    5. Real Estate Documents - title documents and all documents stating the value of any real property owned by either party

    6. Personal Debt - most recent debt statements, showing the outstanding balance and payment terms for all personal debt, including credit cards and other loans

    7. Investments - most recent account statements identifying each investment and showing its current value

    8. Employment Benefits - most recent account statements identifying each employment benefit and stating the current value

    9. Retirement Plans - most recent documents identifying every retirement plan for which the party is a beneficiary, stating the current value and the Summary Plan Descriptions

    10. Bank Accounts - most recent statement for all bank accounts or any other financial institution account and stating the current value

    11. Income Documentation - pay stubs for every source of income during the current and prior calendar year, and for self-employed individuals, a sworn statement of gross income, business expenses necessary to produce income, and net income for for the previous three (3) months

    12. Employment and Education-Related Child Care Documentation - documents showing a party's average cost for employment-related child care expenses

    13. Insurance Documentation - documentation for all life, health, and property insurance policies showing beneficiaries, coverage, cost, and payment schedule

    14. Extraordinary Children's Expense Documentation - documents showing the average monthly expense for all recurring extraordinary children's expenses
